Connecting Directors vs. SCI: Is The Pot Calling The Kettle Black?

          I have been puzzled recently, concerning what one could consider a microscopic inspection of a particular funeral corporation. Of course, I am talking about the continuous postings of negative stories relating to Houston-based Service Corporation International by website Connecting Directors.

          Here’s what is puzzling. Connecting Directors is promoted as a site where funeral directors connect. In fact, founder and self-proclaimed social media “expert” Ryan Thogmartin has said “It’s like Facebook for funeral directors.” Thogmartin, although not a licensed funeral director, is usually quick to offer support when the funeral industry comes under fire – except when the story relates to SCI.

          When the negative headlines target an independently-owned firm, however, Connecting Directors chooses to ignore. Likewise, when a consumer complains about an independent funeral home, social media “expert” Thogmartin is right there to call the complaint absurd. Some of the Connecting Directors featured stories include:

          In a debate with the late R. Brian Burkhardt, a funeral consumer advocate, over whether or not Connecting Directors is also “anti-consumer,” Thogmartin said:

           "Funeral Directors don’t make funeral consumers spend money they don’t want to. Funeral directors present products and services, the consumer makes the choice to purchase what is presented"

          So, I am not really sure where Connecting Directors stands. Pro-funeral homes? Anti-funeral homes (especially those who do not need "social media experts?") Anti-consumer? It's all very confusing, but then again, so is this feature article from Thogmartin:

Why SCI's Stake In Neptune Society Could Be Good For Independent's

The latest news out of Houston is Service Corporation International's 70% purchase of The Neptune Society. Here's the official executive statements:

"We look forward to welcoming Neptune's associates into the SCI family of businesses," said Thomas L. Ryan, SCI President and CEO. "This partnership is a wonderful opportunity for us to join forces with the largest and fastest growing direct cremation company in North America. Neptune serves a segment of the market that will continue to grow and that we do not currently target through our traditional funeral service and cemetery network. In addition to building on Neptune's successful growth and customer service we will be able to yield immediate synergies by providing back office and fulfillment support through SCI's infrastructure."

Marco Markin, CEO of Neptune commented, "In our stage of rapid growth and development, it is the perfect time to partner with a company having SCI's scale, resources and capital. Neptune is a great organization with fabulous employees and we are all excited to pursue the tremendous growth prospects ahead of us."

Of course, this announcement raises a number of questions. More importantly, the possible impact on the industry as a whole, particularly for independent providers.

Will The Neptune Society take on Dignity Memorial branding?
And if so, will "Dignity Memorial Cremation Packages" become part of the offerings?
Will pricing structure be revamped (prices raised)?

After all, there is shareholder value to consider. If the answer to both, or either of those is yes, that can only be positive for independent owners. In fact, even if the answer to both turns out to be no, I can only see a positive result for independents. Why?

Possible scenarios:

Consumers that have already had a negative "corporate experience"
The "larger the wheel," the larger decline in service
Continued negative headlines and/or scandals

That's just my two-cents worth for the day. Time, I suppose, will reveal the answers.

I have long been an advocate of research, whenever it comes to selecting a cremation provider. It's not even necessary to simply take my word on it, but just look at the headlines. It seems that everyday, a new funeral or cremation scandal emerges. Sadly, like so many others, the funeral industry has its own share of deviants. The latest headlines:

"Arizona Crematory Mishandling Bodies"

Arizona’s funeral board is taking action against All State Crematory in Mesa. The action is in response to an investigation by KNXV-TV back in April.

During the investigation, reporters witnessed crematory personnel storing dozens of bodies in unsanitary conditions in the business and others in a van outside.

The station reported that dozens of bodies were not refrigerated inside the business and many were kept overnight in a van. Maggots were observed on the floor of the crematory and on boxes containing bodies, the station reported.

According to Arizona Funeral Board, All State Crematory’s owner, Franklin Lambert, admitted to the findings of the board’s investigation.

The board will issue a $3,000 penalty, which many feel is rather light punishment.

          This is not the first cremation scandal in Arizona, or in other states for that matter. Likewise, if more television stations launched similar investigations, I can assure you they would find many similar situations.

          For funeral homes who use third-party crematories, this should further demonstrate the importance of paying close attention to the service you are using.

          For consumers, it is especially important to be aware in the fact that your funeral home may contract a third-party crematory. In cases where your loved one is sent elsewhere, you should be asking more probing questions.

Police Discover Cremated Remains In Houston Area Abandoned Funeral Home

Police have learned the cremated remains of 15 people were left abandoned at a now-vacant funeral home.

Those remains, 4 of whom belong to children, were found in the 1250 block of FM 2234 on March 1, according to a Stafford Police Department statement.

Property management personnel helped police move the remains to their department for processing.

Detectives are requesting assistance to locate the family members of the deceased:

State accuses funeral trust of mismanagement

Sacramento, California

State regulators Monday filed a lawsuit against one of California's largest funeral trusts, claiming that millions of dollars worth of customers' money has been "misused, misspent, and mismanaged," according to the Department of Consumer Affairs.

The lawsuit, filed in Los Angeles Superior Court, names the California Master Trust as the defendant. It seeks to take over control of the trust, oust the current directors, and force those currently in control to repay $14 million in missing trust funds.

The trust is one of the nation's largest administrators of pre-need funeral plans -- funeral services paid for while the buyer is still alive. Those plans are sold by individual funeral homes, with the payments held by the trust.

Administrators illegally used those payments to pay more than $4 million in kickbacks to funeral homes in order to make sure their plans were sold to customers, according to the lawsuit.

Funeral Parlor Offers Drive-Thru Viewing

There are drive-thru burger joints and drive-thru banks but now one California city offers the ultimate in drive-thru convenience: drive-thru casket viewing.

Yes, at the Robert L. Adams Mortuary in Compton, south of Los Angeles, it is possible to view the deceased resting in a casket display window while cruising past in your car, the Los Angeles Times reported Sunday.

"It's a unique feature that sets us aside from other funeral parlors," said owner Peggy Scott Adams.

"You can come by after work, you don't need to deal with parking, you can sign the book outside and the family knows that you paid your respects," Scott Adams explained. "It's a convenience thing."

Although the Times reported a handful of drive-thru funeral parlors were known to operate in other parts of the US, this was believed to be the first in southern California, home of cars and convenience.

The paper also pointed out some additional pluses for those who favor mobile mourning: seniors do not have to leave their cars, families can avoid hosting a formal viewing and the disabled can roll past in their wheelchairs.

R. Brian Burkhardt aka "your funeral guy"

Robert Brian Burkhardt, the funeral director who wrote the Your Funeral Guy blog, died after a heart attack on January 19, 2011. He was 58 years old.

In a sad irony, while he was a crusader for funeral consumers, he left his family totally unprepared – no life insurance, no wishes to follow, no computer passwords on file.

Under the nom de plume R. Brian Burkhardt, to distinguish himself from others with the same name, his Your Funeral Guy blog challenged the practices of the funeral industry, from suppliers to funeral homes to cemeteries.

He wrote about wide cost variations for funeral products and services, news, scams and trends in the funeral industry, and he reviewed funeral related books. He started the blog in November 2007 and his last posting was January 17, 2011.

Houston Texas Cemetery Admits To Flubbed Grave Plots

Several children's graves may be mismarked and their families may not even know about it. The problem is at the Forest Park Lawndale Cemetery, owned by Service Corporation International (SCI Hispana), in southeast Houston.

This all came to light because of one Houston-area family. They started asking probing questions about their own loved ones gravesite. They'd been visiting it for years. They planned to place a headstone on the grave.

Their plans suddenly changed when they say a cemetery employee told them they've been visiting the wrong grave all this time. Farrell was furious.

"Where I was sitting was someone else's little girl," LeAnne Farrell said.

When we first asked general manager John Krasnick questions, he wasn't eager to answer them.

Farrell says she was told her son's grave is marked correctly but that several other children's graves may not be.

Strip Mall Funeral Home Taking Heat From Opponents

Bob Healy knew that putting a funeral home in a deserted strip shopping center would be a bit unorthodox, but he said he had a good reason to try something different.

"I'm the No. 1 Hispanic funeral provider in the area," Healy said of his Buenaventura Lakes business, Funeraria San Juan, in Osceola County. "So, naturally, for a second location, I chose to go to another area with a high concentration of Hispanics where I could get good real estate at a good price."

He picked an empty restaurant building at The Shoppes of Kissimmee, a 1980s strip shopping center in the heart of Poinciana. The area is 51 percent Hispanic, according to the 2010 Census, and because there's so much commercial space available there, Healy got a good deal.

But the idea of opening a funeral home in the strip center has been opposed by the nearby Enclave Home Owner Association and by Reich Properties, a real-estate management company that owns space at the shopping center. They want the Osceola County Commission to deny Healy permission to move there even though the county's Planning Board approved it, 6-2. The County Commission is scheduled to hear both sides Monday.

A funeral home doesn't fit in a retail environment, opponents argue, and it would scare away potential tenants in a shopping center that needs them badly. The center has been virtually empty since its anchor, Publix, left a couple of years ago and other stores followed. One of every five houses sits empty In Poinciana, according to the census, and many businesses have closed as a result.

"There are three national retailers poised to spend over a million dollars to renovate the center," John Reich of Reich Properties in Kissimmee wrote in a letter to the County Commission. The company owns about one-fourth of the center's 125,000 square feet.

"However, they have made it clear that they will not move forward if the funeral home locates there," Reich said in the letter. He wouldn't say who the national retailers are.

For those of us who utilize online technology, especially in our funeral homes, we are spending more time these days trying to avoid junk emails, those annoying fake pharmaceutical ads and the friendly folks who travel to the comment section of our blogs to leave the following: “Great post on fashion! Hey, I can save you hundreds on home kitchen cabinets!”

Given the popularity of Facebook, it is no surprise to see an increase in spam knocking on the door. According to Facebook, they are diligently working to curb app-generated spam, with platform spam down 95% in 2010. However, as we know, there isn’t a perfect automated system.

Police: Twin sons found living with dead mother’s corpse

Two brothers, twins, were found living in a southeast Houston home with their dead mother's corpse Monday. According to investigators, police discovered the corpse after neighbors called saying they hadn’t seen the elderly woman in months.

Detectives said they believe the men were living with the 88-year-old woman’s corpse for weeks, possibly months, in the Meadowbrook Freeway subdivision.

Her body was found in the living room and smell was unimaginable, police sources said. They described the scene has a rarity.

Donating body to medical science? It might be shipped outside of U.S., to fill cadaver shortage

For the first time Argentina Customs had to deal with the importation of dead bodies into the country to solve a problem of lack of cadavers for medical training in the city of Mendoza; four cadavers were imported from Colorado in the U.S.

This is the first time that Argentina Customs had to inspect and authorize this type of shipment. The operation was coordinated by Dr. Matthew Roby, specialist in Trauma and Sports Medicine and director of the Laboratory of Cadaveric Surgery in the Central Hospital of Mendoza, Argentina.

"We always have enough bodies in stock, but this time we had to import four additional cadavers for our seminar," said Roby to Clarín.com (in Spanish).

Pennsylvania couple won't be fined for boy buried at home

A township in eastern Pennsylvania has reversed its stance and won't cite a couple who buried their 10-month-old son at home because they couldn't afford a burial plot.

The Reading Eagle newspaper reports Colebrookdale Township commissioners announced Monday they will pay James and Chantal Dodson's expenses for resolving legal questions over the burial of their son, Jesse.

Township Solicitor Jeffrey Karver says both sides have agreed the grave will remain undisturbed.

Last month, the commissioners said the family needed a zoning variance and the burial constituted a zoning violation that could result in fines.

James Dodson said he couldn't afford a burial plot for his son, who died in August of a congenital liver condition that left the family with more than $30,000 in medical bills.

No Nascar Burials For Die-Hard Race Fans

Die-hard race fans won’t be buried at Daytona International Speedway or Homestead Miami Speedway any time soon, a Senate panel said Tuesday.

The Senate Regulated Industries Committee, by a 7-4 vote, rejected a proposal to allow remains to be interred at a motorsport complex.

You can still be buried at a public university though.

The Legislature approved a bill two years ago that allows people to be buried on the grounds of a public university. Former Senate President Jim King, who passed away shortly after the bill was signed into law, was the first person interred on a college campus. He was buried on the Florida State University campus in 2009.

Funeral provider in Houston sold a family a burial vault even though the veteran’s cemetery furnished a concrete grave liner at no charge. The sale was closed because the salesman informed the family that it was a legal requirement for them to have a vault in the State of Texas even though the grave liner was furnished at no charge by the VA. Ken Lambert noticed the additional charges during an invoice review. When the family was asked, they stated what the salesman had told them. They did not think it was right but they went along with it. The funeral home owner was contacted but would not cooperate until Ken stated that the family was prepared to sign affidavits to the Funeral Service Commission and the Federal Trade Commission stating that the salesman sold them the vault as a "legal requirement", which was a specific violation of the law. The owner then refunded the $995 for the vault even though the veteran was buried with the merchandise.

The body of 17-year-old Christopher Jacome was brought in a coffin to the General Santander Stadium in Cucuta, the capital of Norte de Santander, during the Sunday match between Cucuta Deportivo and Envigado.

The boy, a loyal fan of Cucuta who belonged to the fan group "Barra del Indio" -- a group known in Colombia for their aggressive antics at soccer matches -- was shot several times Saturday while playing soccer in a local park.

Harry Coover, creator of Super Glue, dies aged 94

The creator of Super Glue, Hary Coover, has died in Tennessee at the age of 94.

Dr Coover, who died on Saturday, discovered the well-known adhesive by accident, while working for Eastman Kodak, his grandson Adam Paul said.

An assistant at the company noticed that two new refractometer prisms were glued firmly together by the substance.

Dr Coover and a colleague first realised the potential of the glue in 1951, according to the Super Glue Corporation website.

Cyanoacrylate, the chemical name for this glue, was actually discovered some years earlier.

During World War II researchers were looking for materials to make clear plastic gun sights. The website said researchers dismissed it for that purpose because it stuck to everything.

President Obama awarded Dr Coover the National Medal of Technology and Innovation in 2010.

Ferraro, first woman vice president candidate, dies at 75

Geraldine Ferraro, who in 1984 became the first woman to run for vice president on a major party ticket, only to lose in a landslide, died Saturday. She was 75.

Ferraro died at Massachusetts General Hospital, where she was being treated for blood cancer. She died just before 10 a.m., said Amanda Fuchs Miller, a family friend who worked for Ferraro in her 1998 Senate bid and was acting as a spokeswoman for the family.

A Nightmare Funeral, Casket Falls Into Grave

The Washington Family was already in mourning after having lost the man they called Pops. Then at his burial, something happened that they say you only see in horror movies.

It's a nightmare that Bradenton resident Kimberly Washington wishes wasn't real. "I can't sleep. My mind is constantly thinking about it."

Her father, the man she calls her best friend passed away two weeks ago. On Saturday, the final goodbyes took place at Eugene Washington's burial. "My whole world feels like it is falling apart."

But as a home video shows, seconds after the casket was placed above the grave, it tipped over and fell to the ground. "To see that casket fall is something out of a horror movie," says Washington.

ABC 7 contacted the cemetery where the burial took place and they say the situation happened as a result of a malfunction with the casket's lowering device. The cemetery is in the process of contacting the manufacturer of the lowering device. They say nothing like this has ever happened before.

Mortuary School Not a Haven For 'Weird People,' Students Say

Inside a stately brick building on a quiet road in suburban Wheeling, the students learn to care for the dead.

Ranging in age from 19 to 65, they come from across the country to study at Worsham College of Mortuary Science, now in its centennial year.

Despite the subject matter, the school is far from the depressing or macabre place that many imagine.

For these students, the mystery of death is fascinating and even beautiful. At Worsham, they learn the art of restoring a face, the science of embalming a body and the poetry in retelling the story of a life.

This is a pretty good story. I remember the mortuary school stereotypes. However, I recall it was a couple of professors that were weird. I recall one who enjoyed wearing lime green and pink suits, which we eventually learned to overlook.

But it was the anatomical teaching aide, which we found unusual.

Our professor had given the torso a name, which seemed ok. What we students found interesting was hearing him talking to the torso and every afternoon, carrying it to his car and placing it in the passenger seat to take home. And yes, he attached the seatbelt.

Conduct of national company's local workers called 'outrageous, grossly negligent'.

A Nashville woman is seeking $16 million in damages for alleged “outrageous, grossly negligent, indecent, reckless” conduct by a death care services provider.

Sharon McNabb filed suit against SCI Tennessee Funeral Services in Davidson County Circuit Court this week, claiming the company’s local workers botched burial arrangements for her deceased husband and “talked her into” cremating his body.

According to the complaint, Andrew Raymond McNabb had purchased a plot at Woodlawn Memorial Park from Woodlawn Funeral Home in 1989. After his death on Dec. 17, Sharon arranged for a Dec. 20 viewing and Dec. 21 service at Eastland Funeral Home before the interment at Woodlawn Memorial Park.

The arrangements were proceeding according to plan until SCI workers notified the McNabb family — during the funeral service — that they in fact had no burial plot at Woodlawn and said the “best thing” to do was cremate the body. According to the complaint, McNabb consented, though she was “completely distraught” and “heavily sedated” at the time.

Then, more than a week after the cremation, McNabb received a notice from the Tennessee National Guard War Records Section that her husband was a veteran and was eligible for burial at the VA Cemetery — notice that SCI had received the day before the funeral.

“Instead of telling her that he could be buried in a VA Cemetery, SCI staff talked her into letting them cremate him for a fee, when at the time it should have been obvious that she was suffering from great emotional distress,” the complaint reads. “This conduct was outrageous, grossly negligent, indecent, reckless, and willful and the kind that is not tolerated by civilized society.”

Woman Sells Self (As Live Cadaver) On Craigslist To Pay Off School Debt

A Boston parent said he or she is willing to sell body parts to pay off his or her children's school debt.

The ad, "Do You Need A Live Cadaver? Take My Body," was posted in the "jobs wanted" section of Boston Craigslist earlier this week.

The poster offered up his or her body for anything "legal or medically experimental" to raise money to pay off their children's student loan debt.

"If you eliminate my children's student loans, I will give you my life!" the poster wrote.

The poster said they were 5 feet 10 inches tall, 200 pounds and have all their "organs in working order."

"Take my blood, take my plasma. Drill into my brain, my leg, my arm. Tap my heart, my liver, my kidney," the poster writes, adding, "I am very very serious."

California Lawmaker Tries Again to Legalize Liquid Cremation After Safety Concerns Raised

A California lawmaker wants to give families a third option, which is being pitched as a "green alternative" to traditional cremation -- chemically dissolve the body, keep the powdery residue and pour the liquefied remains down the drain.

But the procedure, too graphic to describe, has had some trouble getting off the ground. Assemblyman Jeff Miller had to shelve his proposal last year after a visiting scientist pointed out that the process might not be as safe as advertised.

Her 11-year old son was shot and killed. If you think things couldn't get any worse, you're wrong.

The grieving mother, now, isn't sure where her deceased son's body is.

"A person's worse nightmare" Fort Bend County Deputy District Attorney Scott Carpenter said.

Carpenter said the mother turned to Rylan C. Scott Funeral Home in Stafford after her son was shot and killed. In addition to funeral services for her son, the mother said she bought several burial plots.

"She thought it would be nice to, when she ultimately dies, to be buried close to her son. So she arranged with Mr. Scott to purchase three funeral plots adjoining her son's," Carpenter said.

Carpenter said the mother in mourning paid $2,100: $700 for each plot.

According to Carpenter, 29-year-old Rylan Charles Scott told the mother he was part owner of a cemetery in Stafford. In fact, Craven Cemetery is a place where Fort Bend County buries the poor for absolutely free of charge.

"Mr. Scott has been indicted for selling funeral plots here in Fort Bend County that he did not own," Carpenter said.

The grieving mother said when she visited the plots; the ground had not been disturbed. She said Scott then told her the location of the plots had changed and her son was buried in a different spot in the cemetery in an unmarked grave.

Rylan Charles Scott has been indicted on two felony counts including theft and tampering with a government document. The state of Texas slapped the Rylan C. Scott Funeral Home with seven different state violations from 2007 to last year after a number of complaints.

The funeral home has now changed ownership, according to the state. The Texas Funeral Service Commission oversees Texas funeral establishments.

Anyone can make an open records request with the agency to find out if the funeral home they are planning to do business with has complaints against it. That is one step that could have avoided a lot of heartache for this grieving mother.

Another Visit To Cremation FAQs

In light of recent mail and some of the headlines surrounding scandals involving cremation providers and cremation “societies,” I think it might be a wise choice to re-post some cremation FAQs. In choosing a provider, it is always in your best interest to ask tough questions.

I have talked about this before, but I am asked quite often about cremation societies. As someone recently asked, “what are they and is there a benefit from using one?” Well, I would never say to not use one, as I am not personally familiar with all of them. However, I know of a few that I would absolutely advise you to avoid at all costs.

First, here is what they are. An individual, maybe licensed, maybe not, decides to open up a storefront business offering cremation. As part of a marketing campaign, they decide it might sound unique to call their business a cremation society. While they offer cremation services, they do not actually own their own crematory (or retort) where the actual cremation takes place. They often accept bids from outside crematories and pick the lowest bidder. A few locations like this hire an independent person, someone with a van, to make the removals (pick up your loved one) from the place of death. This person will act as if they are an actual employee of the cremation society. Your loved one may or may not actually ever be taken to the storefront business.

Whenever you make arrangements at the storefront, the business representative will probably not tell you that they do not own their own crematory. I would go so far and say that you will never know that the storefront representative will never see your loved one. I have heard of one independent contractor who, after making the removal, will transport the body more than 100 miles to a third-party crematory. The body will be stored there, until cremation documentation arrives.

So, should you use a cremation society? Well, that is a decision that only you can make. However, as I always point out, education is very important. Ask questions, especially about the use of third-party contractors and crematories. You should always ask.

· Is the owner of the facility a licensed funeral director?

Do they own their own crematory?
What are their guidelines for chain-of-custody of the body?
Where will your loved one be taken?
Who will be transporting your loved one?
Does the off-site location offer refrigeration?
Has the storefront owner actually visited the outside crematory?
How can they be certain the correct cremated remains are returned?

I always enjoy your notes and comments. Today, I have a letter that I received from someone in the Houston, Texas area who decided to ask the right questions when considering a funeral or cremation provider. She writes:

I contacted a cremation society in my area, to ask a few questions, based on your guidance in an earlier post.

First, I was transferred to their funeral director. The lady immediately interrupted me and said that she could did not give pricing information over the phone. Is that not a violation of some sort? I know that other funeral homes in the area have always provided details over the phone.

The young lady informed me that she is tired of being "shopped" and that she now only allows face-to-face meetings. I am guessing that she probably loses a great deal of business this way. She was very cold and quite rude. Based on her telephone skills, I would never do business with her, but I was curious to know how she would answer questions face-to-face and set an appointment.

Upon my arrival, I realized this cremation “society” was actually a converted house in a less than desirable part of town. As soon as I walked in, there was a dog freely roaming around, which I would think might not be appropriate for all guests. The funeral director’s personality had not changed much from our phone conversation, but she did indicate that it was the owners dog and she just had to “put up with it.”

Using your guidance, I asked about whether or not they owned their own crematory. She said they have access to one. I asked here where it was located and she said it is not nearby, but didn’t offer any other information. I asked her if she had ever been there. She said she had not. So, I asked how she could offer services from a place she had never been to. Her reply, “just like I work here, but don’t own it.” I asked who transported the bodies to and from this crematory. She said the crematory had “a guy.” I asked her if the crematory had refrigeration for those waiting to be cremated. She could not answer that.

Needless to say, I gathered the pricing information and politely told her I would think about it. As soon as I returned to my car, I muttered “fat chance!” I can not believe this funeral director has any business at all. Just thought you might find it interesting. Also, after further research, I found another provider who was able to provide appropriate answers. As always, I enjoy your blog and thank you for looking out for consumers.

Also, the failure of the funeral director to provide pricing information is a violation of the Federal Trade Commission. I am sending you their address and ask that you make a report. A funeral home featured in an 11 News I-Team report about fraudulent practices last October has been found to be in violation of state statutes and rules.

The Texas Funeral Service Commission concluded its investigation of Rylan C. Scott Funeral Services earlier this month. The sanctions are the latest to be leveled against the small Stafford operation that has already faced previous fines for deceptive practices and poor customer service.

Leslie Robinson once paid Scott $2,000 to have her mother’s remains cremated. But she waited over six months for an urn of ashes that was never delivered. Instead, Leslie received them in a box that was handed to her late one night in the parking lot of a southeast Houston gas station.

Social Media Concerns 101: Potential Legal Issues for Businesses

In earlier posts, I have touched on the subject of balancing social media with good business sense. It has been a growing concern, as more and more businesses (with human employees) are becoming more heavily involved in social media. In addition to concerns over reputation management and such, there is another aspect to consider. I am speaking of legal issues. The New York Times article covered the potential legal concerns.

Next week, for example, a National Labor Relations Board judge will consider whether a medical-transportation company illegally fired a worker after she criticized her boss on Facebook, in the federal agency’s first complaint linked to social media.

So while job seekers and employees have long been warned that risqué revelations on Facebook can jeopardize their career prospects, companies are now increasingly facing their own challenges for blunders they or their employees are making in social media.

Part of the problem is that social networks are brimming over with employees’ and job applicants’ personal information. Along with various suits that have grabbed media attention, the potential for further litigation is broad, lawyers caution. For example, a worker could file a sexual-harassment suit after a manager repeatedly tries to friend her on Facebook. Or an applicant might accuse a hiring manager of reneging on a job offer after learning the candidate’s religious affiliation on Twitter.

Certainly, many of these types of disputes may never get far, and new laws may arise that change the landscape. Still, numerous cases have made it to court—or are on their way.

As the article pointed out, the outcome of the upcoming NLRB hearing is unclear. But a few things about this trend, I would agree, are certain. One is that an employer’s best defense against legal action is to establish a social-media policy that outlines what is and isn’t appropriate in social media, and then to train employees on how to follow that policy. A cremation provider or shall we say one of those society types in Houston, upon telephone inquiry, advises that they do not provide prices over the phone for their funeral or cremation services. As the person on the phone indicated, "you must schedule an appointment and visit our facility."

I was reviewing the FTC Funeral Rule. However, I have found no "opt out" clauses or exemption rules for funeral or cremation providers in Houston, Texas. I think I will give them a call.

Judge Sanctions Service Corporation International Cemetery For Evidence Tampering

A Los Angeles judge has sanctioned Houston-based Service Corporation International (NYSE:SCI), owner of Eden Memorial Park in Mission Hills, after finding that the cemetery intentionally tampered with and destroyed evidence related to a class action lawsuit alleging that Eden mishandled human remains.

Judge Anthony J. Mohr of the Los Angeles Superior Court ordered that the plaintiff’s attorney will be allowed to present evidence to the jury showing that SCI willfully tampered with evidence, and the judge will inform jurors that they may reasonably conclude that the destroyed evidence could have been damaging.

The allegations include that the cemetery broke concrete vaults to squeeze more graves into small spaces, and that when bones fell out of the broken vaults, groundskeepers were instructed to discard of the remains in the cemetery dump and Eden secretly buried bodies in the wrong plots and misplaced or lost remains.

50-Count Indictment Handed Down In Massive Preneed Funeral Fraud

A 50-count federal indictment announced Monday accuses six officers of a St. Louis County-based prearranged funeral business of cheating customers and states out of as much as $600 million.

The U.S. Attorney's office in St. Louis announced indictment on fraud, money laundering and other charges against 65-year-old Randall Sutton, 66-year-old Sharon Nekol Province, 64-year-old Doug Cassity, 43-year-old Brent Douglas Cassity, 73-year-old Howard Wittner and 58-year-old David Wulf, all of suburban St. Louis.

All were controlling officers for National Prearranged Services Inc. The indictment alleges illegal acts that caused financial losses for individuals, funeral homes and state insurance guarantee associations.

Shopping Your Business

Have your shopped your business? Now in some cases, I suppose, this might prove to be a difficult task – but not impossible. And it can provide valuable insight into so many areas, maybe some that you have never thought about.

I recall performing this type of research on more than one occasion. Upon accepting a position in Las Vegas, I knew what those that hired me had said. Likewise, I had attempted to learn as much about the location prior to accepting the position.

Once I arrived, I placed a call to the location to get a feel for the basic customer service details, like how many times did the phone ring, how was it answered, etc. I asked a few basic questions to hear the tone of the answer and basic knowledge of the person on the other end. I later paid a visit, appearing as a potential customer. I was pleased with the initial greeting. However, when it came to services and merchandise selections, it soon became clear that a couple of problems existed. The young lady appeared to be a little nervous and not very knowledgeable about the products. Had I been an actual customer, there could have been a number of less than desirable outcomes.

A). I could have felt uncomfortable doing business with someone lacking confidence and product knowledge, resulting in a business loss

B). I could have randomly selected products and later felt buyer’s remorse and frustration, resulting in a negative experience (and possible negative review)

C). I could have become angry and pointed out her lack of knowledge, creating an even greater insecurity

I later returned, wearing a suit and was formally introduced to the staff. My first order of business was to assemble the employees and schedule in-depth training. I not only focused on product training, but we worked together on building their confidence and presentation skills. I am happy to report that with a little time and attention, the young lady turned out to be one of my best sellers.

The Arizona Board of Funeral Directors and Embalmers revoked Paul Parker's license, after a hearing that included a tense question and answering session between Parker and several visibly upset board members.

"This comes after thousands of partially-cremated human bones were found piled in two open pits -- disposed of improperly."

Fifteen years ago, one of the biggest funeral chains in North America added Syracuse to its empire by paying more than $6 million for Pirro & Sons, one of the area’s most prestigious and successful mortuaries.

As it does in other cities, Service Corporation International went on to snap up other area mom-and-pop funeral homes in Syracuse to add to its chain of more than 1,200 mortuaries.

Now the Pirros have split from SCI and one has started an independent mortuary, Thomas J. Pirro Funeral Home, in Salina. That move has sparked a fight between SCI and the well-known Syracuse family of morticians over the right to use the name “Pirro.”

“The biggest problem is: It’s confusing to consumers,” SCI spokeswoman Lisa Marshall said.

Pirro Jr., 39, a fourth-generation mortician, said customers are confused because they don’t know who they are dealing with when they call Pirro & Sons to arrange funerals.

“They don’t realize there are no Pirros there anymore,” he said. “People are calling, thinking they will get the Pirros and they aren’t.”

I was putting together a post on Eternal Reefs as a post-cremation offering, which brings up the options for cremated remains in general. With the rise in the popularity of cremation and folks shopping around, funeral service providers are facing challenges with that ever-burning question from families, "What to do with cremated remains." And as a result, effective sales and marketing techniques should be looked at closely.

Here is an example of bad marketing technique. A local television news station ran a report on cremation options. They visited a nearby "cremation society." On this day, the firm allowed a new and obviously very "green" employee to speak on camera about cremation jewelry. Think about this. In a city with a phone book filled with cremation providers, you spend your 15 seconds of fame by saying, "We sell a ton of it." Putting the poor usage of the English language aside, you tell the city's potential cremation consumers that you can give them what everyone else has. You are not unique. You have nothing special to offer. Your firm is no better than the rest. Furthermore, if they purchase cremation jewelry from you, it will probably match that of their neighbors.

With the new marketing rules affecting the cigarette industry, including the addition of corpse photos to cigarette packages:

Altria Group Inc., the name behind Marlboro, Reynolds American Inc. and other cigarette sellers in the U.S. will soon be placing graphic images such as corpses and diseased lungs on cigarette warning labels and in advertisements to highlight smoking risks.

As part of the biggest tobacco marketing rules change in a quarter century, nine labels will convey the health effects, according to the U.S. Food and Drug Administration. The warnings, required under a law passed last year, are a step toward reducing cigarette-related illnesses, FDA Commissioner Margaret Hamburg said recently.

It caused me to think of how new labeling could affect other businesses. We have all heard that enrollments in mortuary colleges are rapidly declining. I had a professor in college who loved to use the phrase so many of us have heard, "we put the fun in funerals." Maybe it is time to expand on that idea? Maybe billboards?

In a previous post, I talked about my non-scientific research survey, posing the following question to Yahoo Answers:

If you had to decide today, which would you choose, traditional funeral, cremation, or green burial? It looks like I have all the answers I am going to get, so let me share the informal results. What is most interesting, is that one of the choices I offered was not selected at all. Can you guess which one? (pause)

Out of all the answers reviewed, not one person chose traditional funeral. So, needless to say, you can probably guess which chose won first place. In all but three answers, cremation was the first choice.

Overall Results:

Cremation: 189

Body donation: 3

Green burial: 2

Another interesting trend, in terms of comments, was the eco-conscious aspect of cremation, even though green burial was one of the choices. While green burial remains fairly unfamiliar in many areas, consumers tend to equate eco-conscious with cremation overall.

A Born Funeral Star? Not!

I met a young lady, recently licensed as a funeral director in the Houston area, who expressed her career frustration with me. She feels that she is not being taken as seriously as she should be. I asked her what the problem was. She said, “Look at me. I am exactly what anyone would want to see when they walk into a business.” (First red flag).

I asked to see her resume. Upon further evaluation, I noticed that within a period of two and a half years, she has had seven jobs. Six of those have been in the funeral profession. One job was in clothing retail and only lasted two weeks. Her first funeral home position was as a student, at a very prestigious firm. I asked her why she quit that position. “They wanted me to put dishes in the dishwasher, following visitations,” she said. (Second red flag).

Oh dear, let me try and explain something to you. When I began my funeral career, as a student, I can recall cleaning the break rooms (including dishes), vacuuming carpets, changing light bulbs and emptying trash containers following visitations. Later, after becoming licensed, I worked for an independent firm. On slow days, when there were no funerals to be held, I remember us mowing lawns, cleaning cars and even picking up grocery items the owner needed from the grocery store. Did I enjoy every task? Of course not, but he was paying me a salary (and a damn fine one). In addition, I gained invaluable knowledge and experience through him. Guess what? In time, with experience, I made my way to larger opportunities.

As much as even I wanted to, very few (if any) of us begin our careers as funeral stars. However, beginning with a willingness to learn and grow, combined with time, experience and hard work, the career can become a truly rewarding one. Once in awhile, I even find myself missing those trips to the grocery store. I have heard it said, you can’t always change your circumstances immediately, but you can change your attitude.

Social Media Still Knocking on Funeral Industry Doors

In the new world of social media, one recent survey suggests that the funeral industry has been slow in embracing the new technology. This news does not surprise me in the least, as our industry has a long-established reputation of lagging when it comes to change. And, I will go ahead and offer my opinion that such a mindset is at the very root of the problems we face today.

One cannot argue with the rising popularity of social media, along with the proven benefit from a business marketing standpoint. It allows us to connect with people from around the world and get our brand before an even greater audience than ever before. Unfortunately, as with so many things, there is a darker side as well. It presents an opportunity for competitors, disgruntled former employees, ill-intentioned ex-romantic partners and more to bring harm to our business, our reputation and our private lives. One person, filled with the most sinister intentions can initiate harm with one click of a mouse. There have been a number of examples of this, both in and out of our business. I too, faced a similar situation at one point. And although resolved, it presented more than a few minor bumps in the road.

All in all, I recommend and personally embrace social media as a valuable business marketing tool. Seeing so many funeral directors and funeral homes landing on Facebook is, in my opinion, a positive sign. Likewise, Twitter, LinkedIn and other sites provide equally valuable exposure. However, I always advise caution when it comes to your personal or business pages, especially those around you who may have access. While things might appear peachy today, tomorrow remains to be seen. Happy Facebooking my friends!

FAQ About Cremation Societies

I have talked about this before, but I am asked quite often about cremation societies. As someone recently asked, “what are they and is there a benefit from using one?” Well, I would never say to not use one, as I am not personally familiar with all of them. However, I know of a few that I would absolutely advise you to avoid at all costs.

First, here is what they are. An individual, maybe licensed, maybe not, decides to open up a storefront business offering cremation. As part of a marketing campaign, they decide it might sound unique to call their business a cremation society. While they offer cremation services, they do not actually own their own crematory (or retort) where the actual cremation takes place. They often accept bids from outside crematories and pick the lowest bidder. A few locations like this hire an independent person, someone with a van, to make the removals (pick up your loved one) from the place of death. This person will act as if they are an actual employee of the cremation society. Your loved one may or may not actually ever be taken to the storefront business.

Whenever you make arrangements at the storefront, the business representative will probably not tell you that they do not own their own crematory. I would go so far and say that you will never know that the storefront representative will never see your loved one. I have heard of one independent contractor who, after making the removal, will transport the body more than 100 miles to a third-party crematory. The body will be stored there, until cremation documentation arrives.

What are their guidelines for chain-of-custody of the body?

Where will your loved one be taken?

Does the off-site location offer refrigeration?

McDonald's Piping Hot over Corpse Advertising Campaign

McDonald’s Corporation is angry over an advertising campaign that insinuates eating at McDonald's causes death.

The controversial ad is by Physicians Committee for Responsible Medicine (PCRM), a group advocating a vegan diet. The ad shows a corpse still clutching a Big Mac in his hand. It ends with a screen that says, “I was lovin’ it,” taking a swipe at McDonald’s tagline, “I’m lovin’ it.”

Customer Service and Attention To Details

Last week, a dear friend found himself in the position of making funeral arrangements for his aunt. He spoke to me before the appointment and we talked following the arrangement conference. He used a corporate firm in Houston, Texas. I probably don't need to tell you which one. The aunt had a prearranged funeral. The funeral director, according to my friend, continued to stress that without the preneed, the funeral would have been around $30,000.00. I have my own opinions on that, but kept my thoughts to myself.

Upon arriving to the visitation, the service folders contained a great number of mistakes. The funeral home was dirty, especially the restrooms. I also feel the flowers could have looked better. So, at this particular funeral home, $30,000 will get you all this? Typing errors, floors that could use a vacuum cleaner and dirty restrooms? I am curious about what 40 or 50k might bring.

My point is this. Before a family arrives, have printed materials been verified? How's the floors look? Are the restrooms clean? Of course, I made sure the necessary corrections were made to the printed materials. However, if that is service, if the need arises, I think I'll pass.

Father claims condition of son's body when it got to Uganda made him "violently ill."

A Richmond man is suing a Pasadena funeral home, Fairmont Funeral Home, claiming he suffered nausea, nightmares, emotional breakdowns, severe pain and suffering and emotional trauma, grief and sorrow after his son's body arrived for burial in his native Uganda in a state of advanced decomposition.

Nicholas Jjemba, identified by his lawyers as an oil company employee, said in the lawsuit against Fairmont Funeral Home and Cremation Services that he had difficulty identifying his son's remains when they arrived in Kampala, Uganda

Heather Martin, a co-owner of the Fairmont Funeral Home, said she was "shocked" by the lawsuit's allegation

"I know people are shipped from the Middle East war zone and don't arrive in this state," said Nicholas Jjemba's lawyer, Judy Mingledorff. "I don't know any reason why the body of this young man arrived in the shape it was in."

She said the corpse's condition was documented on video.

The Changing Face of Funerals: A Personal Experience

I recently learned that my great aunt had passed away. When the news first began trickling through the family grapevine, as is usually the case, everyone had questions. For the relatives who are up in age and accustomed to traditional funerals, you can probably guess the questions.

Which funeral home was chosen?
When is the visitation?
When is the funeral?
How she will look?

As it turns out, there was no need to choose a funeral home, no visitation planned and no need to wonder about how she would look. Several years ago, she had mapped out her final wishes. She had chosen to donate her body to the University of Texas Health Science Center. She had written her obituary as well. It said:

Arlie Bernice Phillips, 92, passed away on Tuesday, June 29 2010. She donated her body to the University of Texas Health Science Center. A memorial service will be held at a later date.

There was a funeral home involved, one holding the contract for the UT donor program, but the family did not have to deal with them. A memorial service has been planned, not at a funeral home, but at the family’s home. The family has created a guest list, printed service folders and chosen refreshments. They have also gathered photos for personalization.

The only costs involved so far, include the newspaper obituary announcement of approximately $150, the cost of the paper and printing for service folders, as well as purchasing refreshments. The UT Science program can hold a body for up to two years. Once their work is complete, cremation is provided and the cremated remains are returned to the family. I am not aware of my aunt’s wishes surrounding her cremated remains. If ground burial in a cemetery is chosen, certain costs would be involved. However, if the family chooses to scatter, which I somehow suspect she chose, no additional costs would be involved.

This is another example of the funeral industry’s evolution in our society. The details are under full control of the family. Costs have been kept to a minimum. I know that the service will be meaningful and most important, my aunt's wishes will be fulfilled in a way that she wanted.

In line with my latest posts on social media, both the positives and the negatives, comes a story from the Houston Chronicle. Primarily, it covers social media's possible effects on potential employment.

With Facebook and other social media sites, companies can find out a whole lot more about their applicants than what their résumés and references might reveal.

The question may seem simple, but looking at the sites can reveal information an employer wouldn't — and shouldn't - seek during an interview, such as an applicant's religious beliefs or ethnic background. Basing hiring or promotion decisions on such information could cause legal problems.

On the other hand, seeing the applicant's racy drinking-party pictures might well raise concerns about maturity and judgment - concerns an employer might want to consider before making an offer.

Trade Embalming - Hurting In Rural Areas

I was recently contacted by a mortuary service in Texas, concerning a huge decline in business in a historically traditional rural area. The mortuary service serves a number of counties, most with populations of 7,000 or less.

Here's problem #1. This particular mortuary service has placed all emphasis on embalming. The owner has always focused on embalming, shying away from other related skills. He is not familiar with computers, not interested in advertising, knows nothing about social media and is not comfortable meeting with families.

Here's problem #2. Like the rest of the country, cremation is on the rise - even in the rural communities.

Solution for this business: Focus efforts on transportation. Firms that do not have their own crematory still require transportation to and from contracted crematory. Transportation is still necessary for autopsies and delivery to other cities. Consider developing a crematory.

I have talked about the role outsourcing has played in rural communities. However, if your skill level only relates to embalming, chances are it will not be enough in our new age.

The Role of Responsible Social Media In Funeral Service

I have written a few posts on social media's role in the evolution of funeral service. I have been impressed with the number of funeral-related firms embracing social media as a way to promote business and communicate. It is also another important tool with perception. However, as I have also pointed out, there is a need for caution. Marc D. LeVine, Director of Social Media, RiaEnjolie, Inc. responded to one of my posts, with a number of important points.

Hi James:

Regardless of its particular business application, a serious problem that exists with Social Media is that many of its users still do not know what I call the "Rules of Engagement." Also know as, how to behave online.

Social Networking is not much different from traditional one-to-one, face-to-face relationship encounters. Common sense and proper ettiquette apply - equally - in both cases.

The other important thing to remember about online interactions is that whatever is written in social media, stays in social media - and perhaps forever. Everyone needs to fully understand that these posts and tweets can be viewed by friends, relatives and even employers - ten years from now. The rule of thumb has been that if your mother wouldn't approve of it, do not post it in Social Media.

Social Media IS still a natural fit with the Funeral Industry, which is all about warmth and good people relations. If used properly and tactfully, it is a wonderful way to comfort the families of the grieving and to memorialize those that have passed on.

Houston Funeral Service Employees Speak Out

Last week, I had several conversations with Texas funeral home employees in the Houston area. What I was left with was a few humorous, yet disturbing quotes. The quotes:

“I got into this business, because I thought it was about helping people – you know -- a noble profession and all? This job is stupid!”
   - Funeral Assistant (Male)

“This is the worse job. What the hell was I thinking? I am moving back home.”
   - First year, licensed Funeral Director (Male)

“Funeral service in this town is a toxic environment”
   - Two year, licensed Funeral Director (Female)

I find these quotes saddening, especially in such a large city. In fact, it is a corporate hub. Two of those mentioned above work for a corporation, the other for a cremation service. Is this simply a case of employees with a bad attitude, or is there something more?

Guess What's Blooming? The Corpse Flower

"The corpse flower is so rare that only 28 have ever been known to bloom in the United States. The 29th is poised to open any day now at the Houston Museum of Natural Science and other locations around the country."

So, why the name?

"As its common name warns, the corpse flower is a smelly thing, with the withering stench of rotting flesh. As the spathe begins to unfurl, the spadix becomes a gas chamber, heating its natural oil and emitting noxious fumes for eight to 12 hours to attract pollinating carrion beetles."

More Feedback on Media Attacks Against Funeral Industry

In my continuing research into media attacks against the funeral industry, I am receiving opinions from those in and out of the profession. We all have opinions, including my own. However, my own opinion has been ridiculed as "false" and "unfounded" by funeral industry "expert" R. Brian Burkhardt. He provided the following:

"The Virginia Funeral Home scandal at National Funeral Home involved embalming. This Funeral Home did not meet Embalming standards and corpse care needed for delayed funerals at Arlington National Cemetery. That is where the corpse( Veteran body desecration) abuse came in."

"Remember OJ-Just because charges are dropped does not mean a lack of guilt!"

While I appreciate him clearing Virginia up for us, I am concerned about the end of his comment. I mean, in his "expert" opinion, are we to not really concern ourselves with actual facts or await the outcome?

Another blog, which I will not mention (due to tastelessness), sent the following in regard to recent events in Ohio. It appears that they are in the same frame of mind as Mr. Burkhardt:

"Presumed innocent until proved guilty? That's a courtroom, not public opinion. Only God can judge? Obviously not. Politically correct? Tact? Morals? You won’t find much of that with us."

Social Media and Funeral Service

In May, I talked about social media and the role it can play in the funeral industry. As the business continues to evolve, and the need for better ways to market our services, I am all for using social media platforms. Well, with that said, I have also pointed to a fair amount of caution. My latest posts have involved media and public perceptions about funeral directors and the industry in general. In viewing certain Facebook pages, Twitter tweets and various blogs, it amazes me at some of the things funeral professionals post. I think many forget the separation between professional and personal lives. So, on a funeral home Twitter page, it is not uncommon to see condolences posted and immediately followed by a student's account of how hungover they are. Remember, public perception?

New media expert Alfred Hermida says "the problem is that social media straddles both the personal and professional, meaning staid messages are inevitably going to share space with posts about people's coffee preferences."

"The Internet is a place where people talk, like in life. And life is messy," says Jeff Jarvis, a widely read media blogger and associate professor at the City University of New York's Graduate School of Journalism.

It's All About Perception

Since the start of my examination into the negative view of the funeral industry lately, based on the news headlines and such, I have received a great deal of feedback. Both in and out of the profession, different viewpoints are emerging. R. Brian Burkhardt provided an interesting view of the demise coming from within. This due in part to the rise in cremation, competition, and a breakdown in ethics as a result. To some degree, I believe that Mr. Burkhardt speaks with sound logic. I agree that the "biz" is not helping the cause much.

In terms of those outside the profession, Charles Cowling brings just the right word - perception.

"Funeral directors know that they are viewed with suspicion, aversion, distrust. It’s what they do that lies at the root of this – the dark art of dealing with dead bodies. Yuk.For all my exposure to death I am not reconciled with it, I hate it. And I could never be a corpsehandler. I speak for the vast majority of humankind. But because of my exposure to death, I deeply respect those who do it, and do it well. It’s the perception of everyone else that needs attention. But how is that done?"

Feedback On Media Attacks Against Funeral Industry

Another blog, The Business of Death, featured a quote from me regarding my thoughts on the recent media attacks on the funeral industry:

“What is troublesome is the fact that there is no follow-up by the media whenever cases are dismissed, charges dropped and allegations are proven to be false – many of which are made by competitors and disgruntled ex-employees. Much of the focus has been on the embalming process, by those who know nothing about the techniques involved (which to an outsider might sound like abuse of a corpse) and create sensational headlines,” Patton says

R. Brian Burkhardt, yourfuneralguy.com, immediately fired back with the following:

"This claim is false all the stories mentioned have been followed upon in the press-over and over again!"

At times, concerning funeral industry issues, he and I agree. At other times we don't. I guess this time, we'll simply have to agree to disagree.

Media Throwing Punches At Funeral Industry

It seems like each day, over the past year, the media has been on the attack against the funeral industry. It is as if we have returned to the days of Jessica Mitford. In their battle for ratings and quest for sensationalism, many outlets have stooped to the lowest levels of putting a personal spin on allegations. We have been bombarded with headline phrases like abuse of corpse and corpse mishandling. If you are like me, the word corpse is offensive. However, I suppose it makes for better headlines. I would also suspect that it is easier to take things out of context when referring to a corpse as opposed to a deceased individual. I have also noticed that while the media is quick to jump on allegations, they are never around for the outcome. This is especially true whenever the facts prove to be different from the allegations. I have had some personal experience with this, stemming from a situation involving a disgruntled employee.

A number of funeral directors and embalmers have been targeted. From Virginia to Ohio and a number of other states, our profession has had its share of bad press. Let's not forget the situation in Puerto Rico, involving a different viewing concept. Of the allegations made over the past year, many began as rumblings from disgruntled former employees, competitors and even consumers with questionable motives. I would predict that as society changes and our business continues to evolve, things will only get worse. As long as we have the need to terminate employees from time to time and our competition increases, even more professionals will be at risk. The internet has added a new threat to the profession, offering amateurs the opportunity to play journalist with weblogs. These are often worse than the mainstream media in terms of a misrepresentation of facts. As far as allegations of corpse abuse, every funeral home employee who comes into contact with a decedent is at risk. The majority of allegations over the past year have been made by those not at all familiar with the first call approach, the embalming process or dressing and casketing. The embalming process alone puts every embalmer at risk for allegations.

So, what can we do? We have the same tools available to us, from the mainstream media to weblogs. We can report the positive things that are happening in our business daily. We can talk to people and increase public awareness about our business. Social media is a great way to reach out and open-up about our profession. Together, we can make a difference and help turn things around.

Disturbing Corporate Sales Practices?

I had a conversation with a young lady, who recently interviewed with a large funeral service corporation for a preneed funeral sales position in Houston, Texas. I will let you figure out which corporation I am speaking of.

She was rather upset, following her interview. She said the Manager said the following. "Sometimes, you might need to do and say whatever is necessary to get a yes from a sales lead. Some might consider this unethical, but I call it sales. How would you feel about that?"

I am happy to report that the young lady excused herself from the interview and decided to look elsewhere. Good for her!

There has been the question making rounds "Is The Funeral Industry Getting Ready To Boom?" Our business is recession-proof, isn't it? I mean, it's not a question of if, but only when - right? Surely, our business will survive. And the baby boomers that everyone has said would cause our business to explode?

So again, is the funeral industry ready to boom? Here’s my take: The answer is simply yes and no. The changing environment in the business today is bringing new ideas to light. As consumers are becoming better shoppers and the internet is replacing the phone book, there are certain businesses that will see an increase in sales. Cremation providers and those offering eco-friendly alternatives, if they keep a fine-tuned ear focused on consumer concerns, will benefit.

Traditional providers with an open-mind and those willing to embrace the changes will also benefit. The corporations, though facing huge declines in revenue and sales, are not going away. Those small firms still hiding cremation urns behind smoked windows and hanging on for dear life to the “this is the way we’ve always done it” may soon have to find a supplemental form of income, like telemarketing, or dog washing.

I was scanning the internet for recent articles and news stories, as I generally do. My mind has been focused on the dramatic changes happening in the funeral service industry. One blog read: The wake-up call has arrived. Funerals aren't what they used to be. But then, people don't die the way they used to, either. So, from a consumer standpoint, what is at the heart of this new evolution? For many, a changing in attitudes about death has occurred. Along with that, religious beliefs have shifted for some. The more traditional, religious funerals of the past are beginning to transition into a theme of celebration. There are more regional issues these days, with family and friends often scattered around the country.

Today, unlike the years gone by, families no longer have to completely rely on the hometown funeral director. The expectations are different, and they should be! Families now have more freedom in planning a funeral that is unique and fitting to the personality and life of their loved one. Technology has offered more shopping platforms, allowing consumers to consider greater options, calling upon whomever they feel can provide them with the most spiritual, fulfilling, intimate, and memorable event possible. In addition to funeral homes, there are even funeral consultants and event planners. The internet provides access to websites, blogs, funeral homes and products. The internet also makes it easier to compare prices.

This evolution has set entirely new standards for the funeral service profession. There continues to be a fair number of funeral homes and directors still grasping only the traditional choices of the past. I feel sad for them and their business. As an industry consultant, I am excited about the changes. These changes make the consumer better, me better and hopefully, our industry better. I will close with my often repeated line. Our industry is one in change. Those that are willing to embrace change and innovation will win.

Embrace Social Media, But Use Caution

I have talked a lot lately, about the use of technology and social media for your business and professional life. As a consultant, I advise funeral homes and employees to establish a social media platform. While many businesses are already well into their own campaign, the funeral industry has been slower to follow. The industry is in a state of evolution, with newer approaches necessary to gain and maintain market share.

While I am on my own platform, pitching the use of technology and social media, I must advise caution too. I have noticed comments on both Twitter and Facebook from funeral home employees that are not presenting the best image of their firm. I recently followed a Twitter account of a funeral home, where employees were posting tweets on how much they drank the night before. The tweets went on to refer to the employee’s desire to reach 5 O’clock and head to the bar.

It is also important to use caution in terms of allowing employees easy access to your social media sites, internet, computers and other platforms. While this technology can offer so many positive opportunities to promote your name and business, it can also offer an avenue for maliciousness. I became a victim to such an attack last year by a disgruntled employee who was also a friend – or so I thought. Within a very short period of time, she was able to create a number of problems and generate negative publicity. So, be mindful of this, but learn to utilize social media platforms positively and watch your business benefit from it.

The term social media has become quite the buzz these days. Both Facebook and Twitter are at the top of the list of search engine terms on any given day. Check out any newspaper or news-related website and you will see an article on either, or even both. It seems that daily, someone will ask me, “Are you on Facebook?” In almost every conversation, someone will share with me something that was posted on their Facebook wall. I suppose I have joined in as well, following many of my business clients and friends on Twitter.

Have you joined the craze yet? Have you at least thought of incorporating social media into your business? Yes, even the funeral industry is facing exposure my friends. A couple of weeks ago, a high school student died in an automobile accident. In the days that followed, classmates were sending their condolences and sharing personal memories of him on Facebook. His family was both shocked and touched by the number of posts. Local businesses were even sharing funeral arrangements on Twitter.

Let’s face it -- social media is here to stay. I am guessing it will only continue to grow as well. As a funeral director, I too was moved by the Facebook condolences. It further demonstrated to me the true power of social media. I have also noticed a number of funeral homes creating business pages on Facebook, some even posting death notices. Families are creating memorial pages, serving as a tribute to a loved one.

As we move forward and continue to consider the evolution happening in the funeral industry, it is important to embrace social media as a unique marketing tool. As I mentioned, it’s here to stay – we might as well use it to our advantage.

Get The Money First

I have noticed that each time a story or even a mention of “the corporate giants” surfaces, one of the first comments (where comments are allowed) is to criticize them for focusing on money up-front.

Disclaimer: I am not here to play advocate for all the methods practiced within their business.

However, when it comes to the money issue, what is the problem with expecting full payment? My dentist expects payment up-front (excluding insurance funding of course). Walmart expects payment before leaving the store. Last time I checked, you cannot drive away without paying for gas, unless you are exploring criminal options. Why not the local funeral home?

I know of a funeral home, an independent one, which handles about 150 calls each year. In addition to their business costs, staff salaries, medical/dental insurance (which they provide to employees for free), they currently have over $90,000.00 on the books unpaid. Some of that includes repeat business that didn’t pay the second time either. Why? I was told, “we are not comfortable asking for money.” They further explained, “If we press for the money, they may decide to use another funeral home.”

A genuine financial need aside, for the others, I say if they are not willing to pay you – chances are they are not willing to pay your competition either. If they simply do not want to pay, do you really want them? How about for a second time?

Think about it. Considering the past year and the current economy, what does $90,000.00 mean for your business?

Marketing 101 - The Power of Blogs

It was my friend and attorney who first introduced me to business blogging. At first glance, I thought it was just a hobby, or a therapeutic way to relieve the stress of trial law. After a couple of visits to his blog, I was hooked. Not only does he truly understand the law, but he is an interesting guy. He has a huge following as well, from all walks of life. Sure, there are other lawyers, but he also has clients, media personalities, community leaders and housewives who follow.

I won’t bead a dead horse, as I have said it over and over, but our industry is in change. Of those changes, technology is playing a major role. The yellow pages are out. The internet is in. Web sites are in. Blogs are in. Web sites are great for attracting clients and customers, but a professional blog is a way to engross and keep them returning. It is one of the many new great marketing tools. If you want to increase your visibility in search engines, a freshly updated blog is the way to go. You should add new content at least once a week. It is pretty easy to get started too. I have listed a couple of simple ways to get started for free below.
